Terms of Service for Hise Estate LLC

1. Ownership and Licensing
1.1. Hise Estate LLC hereby grants the client a rights-managed license, effective upon payment, for the use of the provided real estate photographs. This license is specifically tailored for the promotion of real estate properties and services, encompassing personal marketing endeavors and the listing of homes.
1.2. The license awarded to the client is devoid of any temporal limitations and does not impose any cap on the frequency of usage.
1.3. The intellectual property rights, manifested as copyright, of all photographic works remain unequivocally with Hise Estate LLC. However, clients are endowed with the privilege to utilize these photographs, inclusive of the right to append watermarks, in accordance with the previously mentioned rights.
2. Payment Terms
2.1. Hise Estate LLC accepts various forms of payment, which include but are not limited to Credit Card transactions through Square, Cash, or Check.

2.2. Clients are afforded the flexibility to remit payment either contemporaneously with the delivery of services or in advance, based on their personal preference.
2.3. Hise Estate LLC's pricing structure is comprehensively detailed on our website, encapsulating a variety of packages specifically designed for general real estate photography. Please note that additional fees, notably for travel, will be calculated and communicated following the confirmation of your order.
3. Dispute Resolution & Chargeback Provisions
3.1. Hise Estate LLC firmly discourages the initiation of chargebacks. We urge our esteemed clients to first approach us directly for the amicable resolution of any issues or grievances. Customers can follow the dispute process in 3.3 to contact us.
3.2. In the unforeseen event of a chargeback, a processing fee of $50 will be imposed. Such actions may lead to the client being restricted from future services until this obligation is fulfilled.
3.3. We invite our clients to express their concerns or disputes within a 30-day period following the delivery of services. These should be communicated to us by replying to their order confirmation email.
3.4. Hise Estate LLC is committed to resolving disputes through mediation, with the understanding that the client will bear any costs incurred during this process.
4. Reuse of Photos
4.1. Hise Estate LLC retains the prerogative to reuse the photographs for various purposes as deemed appropriate by the company.
4.2. Clients desiring exclusion from the reuse policy must express their request by responding appropriately to the order confirmation.
4.3. Clients acknowledge that they will not receive notification in the event that their commissioned photographs are subject to reuse.
5. Delivery and Access to Photos
5.1. Delivery of photographs is executed through platforms such as Aryeo, Dropbox, and Matterport, ensuring a seamless and efficient distribution process.
5.2. Clients will have access to their delivered photographs for a period of 12 months, ensuring ample time for their utilization.
5.3. The safety and security of the photographs during transfer and storage are governed by the respective terms of service of the aforementioned platforms.
6. Cancellation and Refund Policy
6.1. Clients retain the right to cancel their service engagements up to 24 hours prior to the scheduled appointment, free of any financial penalty.
6.2. Should a cancellation occur within 24 hours of the appointment, Hise Estate LLC is entitled to a cancellation fee constituting 50% of the total appointment cost.
6.3. The discretion to issue refunds or partial refunds lies with Hise Estate LLC, taking into consideration the unique circumstances of each case.
7. Appointment and Access Requirements
7.1. To ensure the timely and efficient delivery of our real estate photography services, it is imperative that the property is fully prepared and accessible by the time of the scheduled appointment. This preparation includes, but is not limited to, the completion of cleaning, staging, and the vacating of cleaners and other personnel from the premises.
7.2. Clients or their representatives must ensure that Hise Estate LLC's personnel have full access to the property within 30 minutes of the appointment start time. Failure to provide access within this timeframe may result in the job being abandoned.
7.3. In cases where the property is not ready or accessible within 30 minutes of the scheduled appointment time, resulting in the abandonment of the job, a service fee equivalent to 50% of the total appointment cost will be charged to the client.
7.4. We encourage clients to communicate any potential delays or issues related to property readiness in advance of the appointment to explore possible adjustments or accommodations. However, the imposition of the service fee for non-compliance with access requirements is final and non-negotiable.
8. Privacy and Data Protection
8.1. Client data, a matter of paramount importance to Hise Estate LLC, is securely stored within our delivery platforms and payment processors.
8.2. Access to client information is stringently limited to authorized employees of Hise Estate LLC, ensuring the confidentiality of your personal data.
8.3. Our data protection practices are in strict compliance with relevant federal laws, safeguarding our clients' privacy.
9. Amendments to the Terms of Service
9.1. Clients are advised to regularly review our website for any amendments to these Terms of Service.
9.2. Acceptance of these terms is implicitly agreed upon by clients at the time of their booking.
10. Jurisdiction and Governing Law
10.1. These Terms of Service are governed in accordance with the laws of Myrtle Beach, SC, and any legal disputes will be resolved under this jurisdiction.
11. Miscellaneous Provisions
11.1. Hise Estate LLC reserves the right, at its sole discretion, to refuse service to any party at any given time.
